An injunction filed by the Woodland Acres Homeowners Association was heard by Judge Alvin Sharp Thursday morning.

 

The injunction was filed against Presidential Properties regarding a modular home which was moved into the neighborhood.

 

The homeowners assert the home is against  restrictions, which state “no structure of temporary character, trailer, basement, shack, garage, barn or other outbuilding shall be used on any lot at any time as a residence, either temporarily or permanently...” It also states “no dwelling shall be constructed or permitted containing less than 1,500 square feet and at a cost of less than $65,000, based upon cost levels prevailing on the date these covenants are recorded,” which was Oct. 17, 2002.

 

Presidential Properties claim the home is modular rather than mobile and the appraised value is $140,000.

 

Judge Sharp granted a stay, which in essence leaves the situation as it is until a court date can be set and both sides can present all of their evidence.
